ECTA and conveyancing
Our legislature introduced the Electronic Deeds Registration Systems Bill in 2017. After its commencement, it will replace the current preparation and lodgement procedures as we know them.
The Bill is totally dependent on the provisions of ECTA. For instance, electronic signatures will be compulsory. This means that all conveyancers need a solid understanding of ECTA to prepare them for the imminent approach of the new deeds registration system.

ECTA, the CPA and POPIA
Understand the important interplay between the different pieces of consumer legislation in South Africa. For example:
- Does your client have a cooling-off right in terms of ECTA?
- If so, what are the legal requirements that must be met?
- Is the CPA applicable to electronic transactions?
- How does the Protection of Personal Information Act 4 of 2013 (“POPIA”) protect customers’ rights in the virtual shopping sphere?
In this webinar, the overlap between ECTA (which is also data privacy legislation) and POPIA will be addressed.
